TERMS AND CONDITIONS

At Soap On A Rope, LLC we want all our clients to understand our inclusions and limitations. We feel it is important to be fully informed on the services and our expectations. Please fully review and let us know if you have any questions or concerns about any information contained in our agreement. We will require you to verify that you read and understood the terms and conditions agreement before we commence any work.

All warranties are limited to those offered by the manufacturers of the products used. Soap On A Rope, LLC makes no additional warranties. If you ever have a concern regarding our work, Soap On A Rope, LLC should be notified immediately.

These terms and conditions serve as a binding agreement between the property owner, hereby identified as “client” and Soap On A Rope and its owners, employees, and subcontractors, hereby identified as “SOAR,” for the execution or services in exchange for payment for residential or commercial ground level and ropes access window cleaning, power washing, and building maintenance. The services that we provide to you are subject to the following terms and we reserve the right to update the terms and conditions any time without notice to you. Window cleaning, glass restoration, skylight cleaning, & post construction cleaning – Pricing does not include removal of paints adhesives, construction debris or mineral stains unless otherwise stated in proposal. Due to widespread problems with poor quality tempered glass scratching during construction window cleaning, SOAR will not be liable for any scratches on any tempered or heat strengthened glass. It is accepted and understood by ALL parties that properly used razor blades and scrapers are standard tools and techniques for construction window cleaning and can safely remove limited amounts of construction debris (plaster, paint, texture, tape, stickers, etc.) from quality glass, without scratching the glass surface.

Furthermore, it is accepted, that the use of razor blades and scrapers will be employed on all construction window cleaning and no other cleaning method will be offered by SOAR to remove construction debris from any glass surface.

If the client does not choose to have the window cleaner use razor blades or scrapers, the client must cover all glass during entire construction process, which would protect glass from any construction debris and eliminate the need for SOAR to use razor blades and scrapers to clean the glass.

Power washing, soft washing – Power washing can cause permanent water damage or other permanent damage in, on, or around the structure and/or other personal property where the service is being performed. SOAR is not responsible for improperly installed siding, loose shingles or siding, broken or opened windows, improperly sealed windows and doors, wood rot, defective construction, improperly secured wires, loose or improperly installed gutters and leaders and improper caulking.

SOAR reserves the right to use on-site electricity and water supply as needed to complete the stated project without compensation. If an exterior water supply is required, it will be at an additional charge. It is the customer’s responsibility to make sure the water supply is on and in working order before we arrive. Additional charges will be applied if water is not available.

Roof cleaning – When the SOAR completes a roof wash service, the client understands that all roofs react to our solution differently and results will vary.

Awning cleaning – SOAR cannot assume responsibility for damage that is caused by fabric deteriorating from sun, pollution, age, and lack of or improper cleaning. We cannot be held responsible for seams or fabric that open during or after cleaning, frames that break due to failure of welds or rust, framework that pulls away from walls, graphics that peel or chip. Cleaning cannot put new life back into an awning or tent that has already been damaged. Examples of damage are stains or streaks that become imbedded and bond to the fabric, building and roof runoff that falls directly onto awnings and chemical stains from prior cleaning.

Surface cleaning & paver sealing – Stains that have become embedded (i.e. oil, gum spots) into concrete or asphalt may not be completely removed or it may take more than one service to see improvement.

Gutter cleaning – Seriously impacted gutter clogs or root growth will be priced separately.

Window glazing – When simply repairing deteriorated areas of glazing and not removing and reapplying all glazing and priming exposed wood, mold may occur from underneath glazing and show as dark spots on the glazing.

Caulking – SOAR cannot guarantee any caulking product or service not provided directly by SOAR. We are not responsible for man-made damage or negligence on the part of the user. This damage and negligence includes chips or nicks due to impact, scratches, e.g., from improper cleaning methods or regular wear and tear, cuts or gouges, stains and discolorations, e.g., from bleaches, dyes or acids,
perfumes, or solvents problems caused by leaking or rust damage, movement of the substructure resulting in cracks or splits in the repaired / refinished surface, caulking degradation, damage to property by failure of repair, or structural problems. Caulking does not guarantee total absence of leakage, manufacturer’s warranties are for product only.

Air duct cleaning – Client understands and agrees that these cleaning services may not totally clean or remove all contaminants, odors, stains or damages in all areas, even after diligent and reasonable efforts by SOAR and Client agrees that no such guarantees, warranties or representations as to results or levels of decontamination, or cleanliness are made by SOAR except as stated in writing in this agreement. Client further acknowledges that there may be hidden or unknown conditions that would affect the cleaning process used by SOAR. And Client agrees that SOAR shall not be responsible for any damage caused by any hidden stains, etc. Client acknowledges that new materials used in restoration may not precisely match existing texture, type, material, or color. Prior to SOAR’s arrival, Client shall notify SOAR of any preexisting or damaged conditions and shall remove all valuables and breakable items from the area where services may be performed, and Client shall be responsible for any loss or damage resulting therefrom.

Flagpole and Banner rigging and repair – SOAR cannot be held responsible for any damage resulting from flying a flag larger than the recommended size per manufacturer’s specifications and/or size recommended by NAAM (National Association of Architectural Metal Manufacturing), damage brought on by high winds, tornadoes and/or hurricanes or tropical storms, heavy snows or any other condition of
nature, damage brought on by accident, collision, vandalism or any other incidental and/or willful act by others.

Lighting replacement – SOAR cannot guarantee any lighting product or services not provided directly by Soap On A Rope. SOAR cannot be held responsible for any failure of the products or services that results from external causes including without limitation: acts of nature; physical damage; exposure to adverse or hazardous chemicals or other substances; use of reactive cleaning agents and/or harsh
chemicals to clean the products; environmental conditions; vandalism; fire; power failure, improper power supply, power surges or dips, and/or excessive switching; fatigue failure or similar phenomena resulting from induced vibrations, harmonic oscillation or resonance associated with movement of air currents around the product; animal or insect activity; fault or negligence of the purchaser of the products, any end user of the products and/or any third parties not engaged by SOAR, improper or unauthorized use, installation, handling, storage, alteration, maintenance or service, including failure to abide by any product classifications or certifications, or failure to comply with any applicable standards, codes, recommendations, product specification sheets, use of products with products, processes or materials supplied by the purchaser of the products, any end user or third parties, or any other occurrences beyond SOAR’s reasonable control.

Holiday lighting – If standard light fastening methods are not possible, additional charges may apply. SOAR cannot guarantee any holiday lighting or fastening provided by the client. SOAR is not responsible for paint chipping due to highly oxidized or deteriorating paint on fascia boards. SOAR cannot guarantee consistent light bulb orientation due to twisting nature of light strands. SOAR will not be held responsible for inadequate, faulty, or overloaded electrical sources at the place of service. Client may be required to provide electrical connection from inside the house. Client requesting large lighting packages may need to consult with their electrician to provide additional power sources commensurate with package needs. Persistent moisture such as rain will create an increase in electrical resistance up to double the load of the lighting package in dry weather.
